Terms of service.
1. Agreement
These terms are a contract between you and {{LEGAL_ENTITY_NAME}}, doing business as Hudor Clothing. By using {{SITE_DOMAIN}} or placing an order, you agree to them. If you do not agree, do not use the site.
2. Who can order
You must be at least 18, or have the permission of a parent or legal guardian who agrees to these terms on your behalf. You agree that the information you give us at checkout is accurate and that you are authorized to use the payment method you enter.
3. Where we sell
We sell and ship within the United States only. We do not currently accept orders shipped to addresses outside the US, and orders placed with a foreign shipping address will be cancelled and refunded in full. If that changes, this page and the shipping policy will say so first.
4. Products, descriptions, and colors
We describe our products as accurately as we can. Garment-dyed and pigment-dyed pieces vary from unit to unit by design, and screen colors differ from fabric colors. Measurements are approximate and cut-and-sew garments carry normal tolerance. We do not warrant that product descriptions are error free.
5. Pricing and errors
Prices are in US dollars and can change without notice. If an item is listed at an incorrect price or with incorrect information because of a typographical or system error, we may cancel or refuse any order placed at that price, even after the order is confirmed. If we cancel for that reason we refund you in full.
6. Orders and acceptance
Your order is an offer to buy. Our confirmation email acknowledges receipt, it is not acceptance. We accept the order when we ship it. We may refuse or cancel any order for any lawful reason, including suspected fraud, reseller activity, or stock we do not actually have. If we cancel after charging you, we refund in full.
7. Payment
Payment is processed by CardConnect, a Fiserv company, through their hosted payment field. Your card details go directly from your browser to the processor and never touch our servers. By submitting an order you authorize us to charge the payment method for the total shown, including tax and shipping. Sales tax is calculated based on the shipping destination where we have an obligation to collect it.
8. Shipping, title, and risk of loss
Title and risk of loss pass to you when the carrier takes possession of the package. Our shipping and returns pages are incorporated into these terms by reference. Delivery estimates are the carrier's and are not guarantees.
9. Returns
Governed by the returns policy at {{SITE_DOMAIN}}/returns, which is part of these terms.
10. Intellectual property
The HUDOR name, the water drop mark, all product designs, photography, and site copy are owned by {{LEGAL_ENTITY_NAME}} and protected by copyright and trademark law. You may not reproduce, sell, or create derivative products from them without written permission. Buying a garment does not transfer any rights in the design.
11. Your content
If you send us photos, reviews, or other material, or tag us publicly, you grant us a non-exclusive, royalty-free, worldwide license to reproduce and display it in connection with the brand, with attribution where practical. You confirm you own it or have permission to grant that license. You can withdraw permission for future use by emailing {{SUPPORT_EMAIL}}.
12. Acceptable use
Do not use this site to break the law, scrape it at volume, probe or breach its security, interfere with other users, or resell our products in a way that misrepresents your relationship to the brand.
13. Disclaimers
The site and the products are provided as is and as available. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow those exclusions, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, {{LEGAL_ENTITY_NAME}} is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of the site or the products. Our total liability for any claim is limited to the amount you paid for the order that gave rise to the claim. Nothing here limits liability that cannot be limited by law.
15. Indemnification
You agree to indemnify and hold harmless {{LEGAL_ENTITY_NAME}}, its owners and employees, from claims and expenses arising out of your violation of these terms or of any law or third-party right.
16. Governing law and venue
These terms are governed by the laws of the State of South Carolina, without regard to conflict of laws rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in {{GOVERNING_COUNTY}} County, South Carolina, and both sides consent to that jurisdiction.
17. Informal resolution first
Before filing anything, email {{SUPPORT_EMAIL}} and give us 30 days to fix it. Most problems are a size, a shipping label, or a misunderstanding, and all three are cheaper to solve by email.
18. Severability and waiver
If any provision is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it.
19. Changes
We may update these terms. The version in force is the one posted here on the date you place your order. Material changes get a new date at the top of this page.
